Failed Flush of Drugs Leads To Raleigh Man Arrested

RALEIGH, NC – A Fuquay-Varina man linked to a large-scale drug trafficking operation in the Raleigh area has been sentenced to 138 months in federal prison after a failed attempt to destroy evidence by flushing cocaine down his toilet.

David Weaver, 46, pleaded guilty on November 19, 2024, to conspiracy to distribute and possess with intent to distribute cocaine and possession with intent to distribute cocaine.

Investigation Uncovers Major Drug Operation

According to court documents, a 2022 investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Raleigh Police Department (RPD) targeted a high-level drug trafficking organization (DTO) responsible for distributing firearms, marijuana, fentanyl, cocaine, and crack cocaine throughout the region. Weaver was identified as one of the DTO’s distributors.

Botched Flush Leads to Seizure of Drugs, Guns, and Cash

On May 23, 2023, law enforcement executed a search warrant at Weaver’s Raleigh residence. Officers encountered him exiting the bathroom after a failed attempt to flush cocaine. A search of the home uncovered:

  • A loaded 9mm pistol
  • 102 rounds of 9mm ammunition
  • Cocaine and crack cocaine
  • Marijuana
  • More than $11,000 in cash

Federal Crackdown on Organized Drug Crime

This case was part of an Organized Crime Drug Enforcement Task Force (OCDETF) investigation, a federal initiative targeting the most dangerous drug traffickers and criminal organizations in the U.S.

Daniel P. Bubar, Acting U.S. Attorney for the Eastern District of North Carolina, announced the sentencing following a ruling by U.S. District Judge James C. Dever III. The case was prosecuted by Assistant U.S. Attorney Kelly Sandling and investigated by ATF and RPD.
